The NWT Manufacturing Products Policy (NWTMPP) was issued pursuant to the Business Incentive Policy (BIP). It raises the possibility of a situation where non-competitive procurement may occur. 

INTERPRETATION

The Executive Council (August 2011) permitted contracts for Approved NWT Manufactured Products where there is only one manufacturer as a class of contracts including the reasons for doing so pursuant to section 4(1)(c) of the Government Contract Regulations (GCR). A class of contracts means a type or group of similar contracts that is approved by way of an Executive Council policy instrument. Therefore, non-competitive procurement is permissible in circumstances described in the NWTMPP.

The Sole Source Authorization Form for Procurement of $25,000 or Greater (IB 705.03) includes the option to select “only one manufacturer of an approved NWT manufactured product”.
